A decision was made by the Community and Planning Services Committee to grant draft approval to Draft Plan of Subdivision File S2019-09, on lands legally described as Part of Lot 29, Concession 3, Geographic Township of Medora, Township of Muskoka Lakes, District of Muskoka. The Draft Plan of Subdivision and Schedule A, which include the conditions of draft approval and the lapsing provisions, are attached.
PROPOSED PLAN OF SUBDIVISION
The subject lands are approximately 23 hectares (55 acres) in size with approximately 197 metres (644 feet) of frontage on Muskoka Road 26 (Foreman Road) and approximately 20 metres (66 feet) of frontage on Muskoka Road 118 (Medora Street). The lands are located in the southwestern portion of the “Urban Centre” of Port Carling, in the Township of Muskoka Lakes. More specifically, they are legally described as Part of Lots 28 and 29, Concession 3, Parts 1-7, 9, 16-18, 20 & 23 on Registered Plan 35R-24515, former Township of Medora, Township of Muskoka Lakes, District of Muskoka.
The plan of subdivision would create a total of eighty-five (85) single detached residential lots and four (4) multiple residential blocks, for a maximum total of 341 residential units, as well as seven (7) blocks for stormwater management, open space and parkland purposes, developed over five (5) phases.
The development is proposed to be serviced with full municipal water and sewer services. All of the single detached residential lots are to be accessed via a new municipal road network connecting to both Muskoka Road 118 (Medora Street) and Muskoka Road 26 (Foreman Road), with the multiple residential blocks proposed to be accessed via internal driveways and/or future condominium roads.
PUBLIC COMMENTS CONSIDERED
Seven (7) letters and a petition with 119 signatures were received with regards to the proposed application, and six (6) property owners spoke at the electronic and in person public meetings.
WHEN AND HOW TO FILE AN APPEAL OF THE DECISION
A notice of appeal to the Ontario Land Tribunal of the decisions must be received by The District Municipality of Muskoka on or before the last day of appeal, March 28, 2024, being 20 days from the date of this notice. The notice of appeal must:
i) set out the reasons for the appeal; and
ii) be accompanied by the fee prescribed under the Ontario Land Tribunal in the amount of $1,100.00
(per decision appealed) payable to the Minister of Finance.
The applicant, the Area Municipality, or any public body that made written submissions to The District Municipality of Muskoka before the draft approval of the plan of subdivision and common element condominium description, may appeal any of the conditions imposed by The District Municipality of Muskoka to the Ontario Land Tribunal by filing with The District Municipality of Muskoka a notice of appeal.

WHO CAN APPEAL A DECISION
Only individuals, corporations or public bodies may appeal a decision of The District Municipality of Muskoka to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be made in the name of an individual who is a member of the association or group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal of the decision of the approval authority, including the lapsing provisions or the conditions, unless the person or public body, before the decision of the approval authority, made oral submissions at a public meeting or written submissions to the council, or made a written request to be notified of changes to the conditions or, in the Ontario Land Tribunal’s opinion, there are reasonable grounds to add the person or public body as a party.
WHEN THE DECISION IS FINAL
The decision of The District Municipality of Muskoka is final if a notice of appeal is not received before or on the last day for filing a notice of appeal.
NOTICE OF CHANGES TO CONDITIONS
You will be entitled to receive notice of any changes to the conditions of approval of the proposed plan of subdivision and common element condominium description if you have made a written request to be notified of changes to the conditions.
No person or public body shall be added as a part to the hearing of an appeal regarding any changes to the conditions of approval unless the person or public body, before the approval authority made its decision, made written submissions to The District Municipality of Muskoka, or made a written request to be notified of the changes to the conditions.
