The following information should not be considered legal advice and is for information purposes only. Inquiries as to whether or not a retail business may be open on any statutory holiday must be referred to appropriate independent legal counsel and the Retail Business Holidays Act (the Act).
The Act is Provincial legislation that prohibits the opening of retail businesses on statutory holidays. This legislation is administered by the Ministry of Government and Consumer Services. There are currently nine statutory holidays as follows:
In addition to certain statutory exemptions, the Act also provides that District Council may pass a by-law permitting businesses to remain open on holidays for the maintenance or development of tourism. In addition to other considerations prior to passing such a by-law, District Council must hold a public meeting to consider an application for exemption. In reviewing an application for an exemption, District Council shall take into account:
