 Exemption by By-law from the Retail Business Holidays Act
The following information should not be considered legal advice and is for information purposes only. Inquiries as to whether or not a retail business may be open on any statutory holiday must be referred to appropriate independent legal counsel and the Retail Business Holidays Act (the Act).

The Act is Provincial legislation that prohibits the opening of retail businesses on statutory holidays. This legislation is administered by the Ministry of Government and Consumer Services.

There are currently nine statutory holidays as follows:

  • New Year's Day
  • Family Day - By Proclamation, (holiday not listed in the Act)
  • Good Friday
  • Easter Sunday
  • Victoria Day
  • Canada Day
  • Labour Day
  • Thanksgiving Day
  • Christmas Day
  • and other public holidays declared by proclamation of the Lieutenant Governor to be a holiday for the purposes of this Act.

In addition to certain statutory exemptions, the Act also provides that District Council may pass a by-law permitting businesses to remain open on holidays for the maintenance or development of tourism. In addition to other considerations prior to passing such a by-law, District Council must hold a public meeting to consider an application for exemption.

In reviewing an application for an exemption, District Council shall take into account:

  • The principle that holidays should be maintained as common pause days.
  • That a by-law may be passed only if there is compliance with the tourism criteria set out in the Regulations.
  • That Council is not required to pass the by-law even if the tourism criteria are met.

  • By-law 95-83 - Your Independent Grocer - Gravenhurst
  • By-law 93-54 - Various retail businesses
  • By-law 92-43 - By geographic location within the District of Muskoka
  • By-law 92-42 - Various Retail Businesses
  • By-law 92-41 - All retail businesses may remain open on Victoria Day and Canada Day
  • By-law 87-53 - To regulate retail business holidays and provide for exemptions through the District of Muskoka
